The Committee also said there were strong indications thatthe existence of the tie pushed up prices to consumers. "It is clear there are many pressures on any retailbusiness, and pubs are challenged by changing consumerpreferences, changes in the regulatory framework and generaleconomic circumstances," said Luff. The Committee acknowledged not all of the problems facingthe pub industry had resulted from the beer tie arrangement.
However, Luff added that rather than making a policyrecommendation, the Committee was recommending the current tiedpub business model be referred to the Competition Commission. He said the provisional view of the Committee was that thetie should be "severely limited to ensure proper competition inthe market". Luff said the inquiry had found "alarming evidenceindicating there may be serious problems caused by the dominanceof the large pub companies". "Our report challenges pubcos to demonstrate the benefits ofthe tie, by offering their lessees the opportunity to run theirpubs on a free-of-tie basis," said Peter Luff MP, chairman ofthe Business and Enterprise Select Committee, which hasinvestigated the practice. The so-called "beer tie" enables companies such as PunchTaverns (PUB.L) and Enterprise Inns (ETI.L), Britain's biggesttwo owners of leased and tenanted pubs, to be both landlords andexclusive suppliers of beer to their publicans.
